BTNL Partner Lowther Obtains Defense Verdict in Jury Trial
BTNL partner Todd Lowther earned a defense verdict on behalf of our client, The Heil Co., after a 4-day jury trial in the Circuit Court of Dekalb County, Alabama. The lawsuit involved an accident at Heil’s Fort Payne manufacturing facility where it manufactures garbage truck bodies. The plaintiff in the case was an employee of a contractor hired by Heil to modify fire protection equipment and piping at the factory. While he was working, the plaintiff was injured in an accident when a forklift operated by a Heil employee ran over his foot and ankle causing a significant lower body injury. The plaintiff brought a lawsuit claiming Heil and its forklift operator were negligent and caused the accident. Heil countered by denying the allegations and asserting the plaintiff himself was contributorily negligent. The DeKalb County jury sided with Heil, reaching a defense verdict after brief deliberations.
