BTNL Partners Barze And Lowther Obtain Defense Verdict In Jury Trial

BTNL partners Bruce Barze and Todd Lowther earned a defense verdict on behalf of our client, Mahindra USA, Inc., after a 4-day jury trial in the Circuit Court of Pickens County, Alabama. The lawsuit arose from the sale and service of a Mahindra 105P tractor sold to Terry Sullivan. The plaintiff sued Mahindra and its dealer (Peach Outdoor) for fraud, suppression, negligence, wantonness, and breach of warranty.

Claims of fraud, suppression, and breach of warranty were submitted to the jury against Mahindra. During closing arguments, Sullivan’s lawyers asked for compensatory and punitive damages of “at least” $3 million. After deliberating for six hours, the jury returned a verdict in favor of Mahindra on all counts. Barze and Lowther obtained this result despite the jury’s verdict against Peach Outdoors (represented by separate counsel) of $150,000 in compensatory damages and $1.3 million in punitive damages.
